Art Viva Terms of Trade for retail and wholesale customers.

The following Terms apply to all products provided by Art Viva. Please make sure you choose carefully as all products are sold relative to the following terms:
1)Art Viva's return policy on goods that are found to have manufacturing faults and are accepted by Art Viva, is to exchange for goods of equal value or to provide a credit towards the purchase of other goods at Art Viva's discretion. Cost of returning faulty items for claim is to paid by the customer.
2)The title of goods shall not pass to the buyer until full payment has been received and payments are cleared by Art Viva.
3)All orders are subject to acceptance and confirmation by Art Viva.
4)Terms and conditions of payment for the goods are strictly Pro Forma (Cash Before Delivery) unless otherwise agreed.
5)Art Viva will not deliver to third party addresses unless otherwise agreed.
6)Art Viva will not be responsible for goods lost or damaged in transit.
7)Customers are responsible for any costs incurred by unclaimed goods or refused shipments.
8)Customers must ensure that someone is available at the delivery address to accept the goods.
9)Art Viva will use its best efforts to ensure that delivery is timely but cannot be held liable for any delayed or lost goods.
10)In the event of a return for credit, Art Viva will deduct the cost of freight incurred from the amount refunded.
11)Art Viva's liability for the goods ceases at the point of dispatch.
12)If an order is cancelled less than 14 days before dispatch a charge of 30% of the purchase price will be applied.
13)All pro forma orders will be held for a maximum of 3 business days after the invoice has been issued to the customer. Should the full amount of the invoice remain unpaid at the end of this 3 day period, the order will be cancelled and the customer shall be liable for a cancellation fee of 30% of the invoice total.
14)Art Viva products are not to be retailed through Ebay or by party plan.
15)Wholesale terms are only available to genuine retailers.
16)Art Viva will not be liable for any goods returned that are found by to be free of faults or goods with physical damage or damage caused by improper use.
In such cases, the customer shall be liable for freight costs.
17)No returns will be accepted without a proof of purchase provided by the customer. The invoice (or copy of) is to be presented for any claims.
18)Any unauthorised returned goods will not be accepted and will be sent back at customer's cost.
19)Art Viva will not accept, refund or replace any damaged goods caused by improper use or damaged in transit.
20)Art Viva operates relative to the trading laws of Tasmania, Australia.
21)Art Viva reserves the right to decline supply to any person or business that it deems to be unsuitable as a retailer or distributor of Art Viva products
